GEM 6-PASSENGER LOW-SPEED VEHICLE RENTAL AGREEMENT, WAIVER OF LIABILITY AND RELEASE

PLEASE READ CAREFULLY BEFORE ACCEPTING — THIS AGREEMENT CONTAINS A RELEASE OF LIABILITY

This Rental Agreement, Waiver of Liability and Release (“Agreement”) is entered into between Coast Carts (“Company,” “we,” “us”) and the individual renting the vehicle described below (“Renter,” “you”). By signing, checking the acceptance box, or taking possession of the Vehicle, Renter agrees to be bound by all terms of this Agreement.

1. Vehicle and Rental

The vehicle covered by this Agreement is a GEM 6-passenger, street-legal low-speed vehicle (“LSV” or “Vehicle”), rented on a per-minute or per-hour basis through the Company's mobile application. Renter initiates a rental by scanning the QR code located on the Vehicle using the app, which unlocks the Vehicle for use. There are no daily, overnight, or other long-term rentals.

2. Renter Eligibility and Requirements

  • Renter must be at least 25 years of age.

  • Renter must hold a valid, unexpired, unrestricted U.S. driver's license, and must present it for verification before the rental begins. The Vehicle is a motor vehicle intended for operation on public roads and requires a valid driver's license to operate.

  • Renter must carry valid personal automobile insurance and must present proof of insurance and a credit card before the rental begins.

  • Renter must not have consumed alcohol prior to the start of the rental, and must not consume or be under the influence of alcohol, drugs, or any impairing substance at any time during the rental.

  • Only the Renter who has personally signed or accepted this Agreement and provided a valid driver's license may operate the Vehicle. No other person, including any passenger, may operate the Vehicle under any circumstances. Renter remains fully responsible for the Vehicle and all liability arising from its use, including any use by an unauthorized person.

3. Operation of the Vehicle

  • Renter agrees to operate the Vehicle in compliance with all applicable federal, state, and local traffic laws and posted signage.

  • The Vehicle may not be operated on any highway or limited-access road, and may only be operated on roadways where operation of a low-speed vehicle is otherwise permitted by law (generally, roads with a posted speed limit of 35 mph or less).

  • MAXIMUM CAPACITY: 6 PASSENGERS. The Vehicle is rated and licensed for a maximum of 6 occupants total, including the driver, at all times. Renter agrees that the number of occupants in or on the Vehicle will never exceed 6, under any circumstances, regardless of age or size of the occupants. Exceeding this limit is a material breach of this Agreement, may result in immediate forfeiture of the security deposit, and Renter assumes full responsibility and liability for any injury, damage, or citation resulting from a violation of this capacity limit.

  • All occupants must wear a seatbelt at all times while the Vehicle is in motion.

  • Any child occupant younger than 8 years old or under 57 inches in height must be secured in an appropriate booster seat. The Company does not supply booster seats; Renter is responsible for providing one if needed.

  • The Vehicle has a range of up to 50 miles at full charge. Renter is responsible for monitoring the Vehicle's battery charge level throughout the rental. If the Vehicle runs out of charge and becomes inoperable or stranded, Renter forfeits the full security deposit and is responsible for all towing and recovery costs, in addition to any other fees owed under this Agreement.

  • Renter agrees not to tow with the Vehicle, operate it off-road, use it for racing or stunts, or permit any unauthorized or unlicensed person to operate it.

  • Renter must not tamper with, disable, or attempt to remove any GPS, telematics, or tracking device installed on the Vehicle.

4. GPS and Telematics

Renter consents to the collection and use of real-time GPS location, speed, and usage data from the Vehicle for purposes including safety, fleet management, billing, recovery of the Vehicle, and investigation of any incident or violation. The Company may remotely limit the speed of, disable, or immobilize the Vehicle if it is operated outside an authorized area, in violation of this Agreement, or if the Company reasonably believes the Vehicle is stolen, abandoned, or being misused.

5. Emergencies and Incident Reporting

  • In case of a medical emergency, call 911 immediately.

  • For non-medical support, contact the Company through the app or at [PHONE NUMBER].

  • In the event of an accident or injury, Renter must call 911 if needed, notify Renter's own automobile insurance company, and notify the Company immediately.

  • Any accident, crash, damage, or lost or stolen Vehicle must be reported to the Company within 2 hours of the incident.

6. Traffic and Parking Violations

All traffic and parking violations incurred during the rental period are the sole responsibility of the Renter, regardless of whether the violation is discovered during or after the rental period ends.

  • A processing fee of $35 applies to each such violation, in addition to the fine or citation amount itself.

  • Renter authorizes the Company to charge the payment method on file for the full amount of any citation, toll, or fine, plus the applicable processing fee, without further notice.

  • If a citation is issued directly to the Company as the registered owner of the Vehicle, Renter agrees to reimburse the Company in full within 10 days of notice, and agrees that the Company may identify Renter to the issuing authority as the operator of the Vehicle at the time of the violation.

7. Vehicle Condition and Damage

  • Renter is required to take photographs of the Vehicle's condition through the Company's app both before beginning the rental and after ending the rental. Failure to take the required photographs may result in Renter being held responsible for any damage discovered upon return, as the Company will be unable to verify the Vehicle's condition at handoff.

  • Renter is responsible for inspecting the Vehicle before use and reporting any pre-existing damage before the rental begins.

  • Renter (the “Primary Driver”) is responsible for all damage to or loss of the Vehicle upon its return, including damage or loss resulting from Renter's use, misuse, or failure to properly secure the Vehicle.

  • The current estimated full replacement cost of the Vehicle is $25,000, subject to change and available upon request.

8. Payment and Deposit

  • Rentals are initiated and paid for through the Company's mobile application on a pay-per-use basis. There are no advance reservations, and no cancellation, no-show, or late-return fees apply.

  • A security deposit of $100.00 is required on all rentals and will be pre-authorized on Renter's payment method at the start of the rental. The deposit will be released or credited back upon return of the Vehicle in undamaged condition with no items missing, and subject to Section 3 regarding battery charge.

  • Renter authorizes the Company to charge the payment method on file for the rental fee, the security deposit, and any fee or charge described in this Agreement.

  • No refund or credit will be issued if Renter is unable to end a rental because Renter's phone battery dies, loses signal or connectivity, or otherwise becomes unavailable. Renter remains responsible for all rental charges that accrue until the rental is properly ended through the app or the Company is contacted directly.

  • Rental may be ended by Coast Management at any time for any issues and no refund will be given.

9. Insurance

Renter's personal automobile insurance policy may or may not provide coverage for accidents or damage involving the Vehicle. Renter is responsible for confirming coverage with Renter's own insurance company or agent before renting. The Company's own insurance on the Vehicle, if any, does not extend to cover Renter's personal liability to third parties.

10. Assumption of Risk

Renter understands and acknowledges that operating a low-speed vehicle on public roads shared with pedestrians, bicycles, and other motor vehicles involves inherent risks, including collision, injury, or death, and Renter voluntarily assumes all such risks in exchange for being permitted to rent and operate the Vehicle.

11. Release, Waiver, and Indemnification

TO THE FULLEST EXTENT PERMITTED BY LAW, RENTER, ON BEHALF OF RENTER AND ANY PASSENGERS, RELEASES, WAIVES, AND FOREVER DISCHARGES THE COMPANY, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO RENTER'S RENTAL OR USE OF THE VEHICLE, INCLUDING CLAIMS ARISING FROM THE COMPANY'S ORDINARY NEGLIGENCE, EXCEPT TO THE EXTENT CAUSED BY THE COMPANY'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

Renter agrees to indemnify, defend, and hold harmless the Company from any third-party claim, citation, fine, judgment, or expense (including reasonable attorneys' fees) arising out of Renter's operation of the Vehicle, including any traffic or parking violation, accident, or injury to any third party.

12. Limitation of Liability

In no event shall the Company's total liability to Renter for any claim arising out of this Agreement exceed the total amount paid by Renter for the rental giving rise to the claim.

13. Governing Law and Venue

This Agreement is governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Renter agrees that any dispute arising out of this Agreement shall be brought exclusively in a state or federal court located in Barnstable County, Massachusetts.

14. Severability and Entire Agreement

If any provision of this Agreement is held unenforceable, the remaining provisions remain in full force and effect. This Agreement constitutes the entire agreement between Renter and the Company regarding the rental of the Vehicle, and supersedes any prior agreement or understanding, written or oral.

RENTER ACKNOWLEDGMENT

By signing or checking “I Agree,” Renter certifies that Renter has read and understood this Agreement in its entirety and agrees to the following:

  • I am 25 years of age or older.

  • I hold a valid U.S. driver's license and have presented it for verification.

  • I carry valid personal automobile insurance and have presented proof of insurance and a credit card.

  • I have not consumed alcohol before this rental and will not consume alcohol or any impairing substance during this rental.

  • I understand the Vehicle may never be operated on a highway.

  • I understand the Vehicle's maximum capacity is 6 passengers total, including the driver, at all times, and I will never exceed this limit. I understand that all occupants must wear seatbelts at all times.

  • Any child occupant under 8 years old or under 57 inches will be secured in a booster seat that I will provide.

  • I understand I am solely responsible for any traffic ticket or parking violation issued during my rental, plus a $35 processing fee per offense.

  • I understand I am required to take before-and-after photographs of the Vehicle through the app, and that failing to do so may leave me responsible for damage the Company cannot otherwise verify.

  • I understand that no refund or credit will be given if I am unable to end my rental because my phone's battery dies, loses signal, or otherwise becomes unavailable, and that charges will continue to accrue until the rental is properly ended.

  • I understand I am responsible for the full replacement cost of the Vehicle if lost or damaged.

  • I understand I am responsible for monitoring the Vehicle's battery charge, and that I will forfeit my full security deposit and be responsible for towing costs if the Vehicle runs out of charge and becomes stranded.

  • I authorize a $100.00 security deposit hold on my payment method as described in Section 8.

  • I voluntarily assume all risks of operating the Vehicle and agree to the release, waiver, and indemnification in Sections 10–11.
